Two-Factor Authentication: We require two-factor authentication (2FA) via SMS for all account access. By providing your phone number, you consent to receive authentication codes and security alerts.

Our Rights: The Service and all content, features, and functionality are owned by CaptableHero and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Your Rights: You retain all rights to the data and information you upload to the Service. By uploading content, you grant us a license to use, store, and process that information solely to provide the Service to you.
Feedback: If you provide us with feedback or suggestions, you grant us the right to use that feedback without compensation or obligation to you.

Message and data rates may apply. Message frequency varies. You can opt-out at any time by replying STOP to any message or updating your account preferences. Opting out of SMS may limit your ability to use certain features that require 2FA.
Pricing: Certain features of the Service may require payment of fees. Current pricing is available on our website and may be changed upon notice to you.
Payment Terms: Fees are due in advance and are non-refundable except as required by law. You authorize us to charge your payment method for all fees incurred.
Taxes: You are responsible for all applicable taxes associated with your use of the Service.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTABLEHERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE.
Aggregate Liability: Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
Exceptions: Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

By You: You may terminate your account at any time by contacting us at hello@captablehero.com. Upon termination, you will lose access to the Service and your data.
By Us: We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or for any other reason at our sole discretion.
Effect of Termination: Upon termination, all rights granted to you under these Terms will immediately cease. You remain liable for all fees and charges incurred prior to termination.
Data Retention: We may retain certain information as required by law or for legitimate business purposes. Financial and ownership records may be retained for regulatory compliance.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
Informal Resolution: Before initiating any formal proceedings, you agree to contact us to attempt to resolve any dispute informally.
Arbitration Agreement: Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court. Arbitration will be conducted on an individual basis; class arbitrations and class actions are not permitted.
Exceptions: Either party may seek injunctive or other equitable relief in court to prevent infringement of intellectual property rights.
Opt-Out: You may opt out of this arbitration agreement by notifying us in writing within 30 days of first accepting these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any legal action or proceeding relating to your access to or use of the Service shall be instituted only in the federal or state courts located in Delaware, and you agree to submit to the personal jurisdiction of such courts.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CaptableHero regarding the Service.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
Assignment: You may not assign or transfer these Terms or your rights under these Terms. We may assign these Terms to any affiliate or successor without your consent.
Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
